Credit Card Authorization and E-Sign Consent
By accepting these terms and conditions, you authorize Simply Bits, LLC to charge the credit or debit card account that you have specified for the following types of transactions that may arise in relation to your current Service Agreement:
- Initial billing for set up, one time purchases, prorated monthly charges and monthly recurring charges;
- Charges resulting from changes or one time purchases during the life of your Service Agreement and any amendments that you authorize;
- Service call charges, as applicable, according to the terms and conditions of the current Service Agreement;
- Termination fees or prorated charges for the final month of service.
You agree that the payment card specified by you for payments to Simply Bits, LLC is, and will continue to be, an account that you own, and that you will maintain sufficient availability under your credit card limit, or sufficient funds in the account linked to your debit card, as applicable, to pay invoices from Simply Bits, LLC. Invoices are electronically communicated to customers and then the credit or debit card on file is charged accordingly. Your monthly Simply Bits, LLC invoice will constitute your notice of any variance in the amount that will be charged to your credit or debit card account from month to month according to the utilization and services contained within the current Service Agreement, including authorized changes to service.
These terms and conditions will constitute your copy of your payment authorization to Simply Bits, LLC. Please print and retain a copy of this payment authorization for your records. You can update your payment authorization only by utilization of the payments link that can be found on the Simply Bits, LLC website. Your request to update your payment authorization must be received by Simply Bits, LLC at least three business days before your invoice due date for the month in which your request is made. If your update request is submitted after this time, the update will not take effect until the following billing cycle for your Simply Bits, LLC services. Cancellation of your payment authorization in advance of invoicing and with approval from Simply Bits, LLC for alternative payment arrangements. This cancellation process is not immediate and therefore any charges declined by the issuing bank for the credit card on file will result in a service charge of $20.00 per occurrence.
E-SIGN CONSENT REGARDING PAYMENT AUTHORIZATION
- Scope of Consent-
You acknowledge and agree that by accepting the above credit card authorization terms and conditions (“Credit Card Authorization”), you consent to receive a copy of your payment authorization in electronic form. This consent applies only to the payment authorization that Simply Bits, LLC is required to provide you with a written copy under applicable law. - No Withdrawal of Consent-
Simply Bits, LLC cannot process your Credit Card Authorization unless you are willing to receive the Credit Card Authorization in electronic format. Consequently, once you have accepted the Credit Card Authorization, you cannot withdraw your consent to receive your copy of the Credit Card Authorization in electronic form. However, you will still be able to update your recurring payment authorization in accordance with the Credit Card Authorization Terms. - Paper Copy-
